MAIN COSMETIC LEGISLATIVE DEVELOPMENTS. OCTOBER 2021

Mandates the SCCS to evaluate the ingredients Homosalate and Butylparaben.  For Homosalate the opinion is expected soon, 2 months (12/2021) whereas for Butylparaben the opinion is not expected until 9 months from now (07/2022). We will be attentive and will keep you updated in case of any future impact.

Two draft amendments to Regulation 1223/2009 have been notified to WHO. We will inform you when they are officially published in the official journal of the EU (OJEU).

  1. Reduction of the concentration of benzophenone-3 from 6% to 2.2% in body products including sprays and to 0.5% in other products not covered in addition to the inclusion of the precautionary phrase Contains Benzophenone-3. In the same draft, Octocrylene is also regulated from 10% to 9% when used in spray products with propellant.
  2. Modification of the Annex to the Annex to the Directive.
  3. Modification of Annex V point 2 where the threshold for the indication “contains formaldehyde” is reduced from 0.05% to 0.01%.
